    Latest IR35 tribunal decision

    MDCM Ltd, represented by its director, Mr Daniels, provided services to Structure Tone Limited (“STL”) via Solutions Recruitment Limited (“Solutions”), STL being a construction company that specialised in the fit-out and refurbishment of buildings in London. MDCM’s business is providing construction management services including night shift management, to construction companies.

    Changes to worker status are underway

    In addition to the self-employed status consultation we reported on previously, there a currently changes to the Employment Rights Act being considered which will change the way in which self-employed individuals can be engaged from an employment law perspective.

    The worker status “gig”

    Following the highly publicised “gig economy” tribunal cases we saw the Taylor Review hand down recommendations to reform and clarify the law on “worker status”. A draft Bill is now with the select committee which sets out legislative changes to the definition of “worker”, a new default worker status and a new class of “independent contractor”.
